Welcome to BOND&GRAIN. These Terms of Service ("Terms") are a legal agreement between you and BOND & GRAIN LLC, a Wyoming limited liability company operating as BOND&GRAIN ("BOND&GRAIN," "we," "us," or "our"). They govern your access to and use of bondandgrain.com and all related content, features, products, and services, including our made-to-measure service, newsletter, text messages, social media channels, and affiliate program (together, the "Services").

By visiting, browsing, creating an account on, or purchasing through the Services, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Returns & Refunds Policy, and Shipping Policy. If you do not agree, please do not use the Services.

Before you order: we do not accept returns, exchanges, or refunds if you change your mind. If your jacket does not fit, we offer fit verification (see Section 8). Custom Orders and Sale Items are final sale.

Please read these Terms carefully. They include important information about your legal rights, including how we create our product imagery (Section 3), how returns and refunds work (Section 8), disclaimers of warranties, limitations of liability, and how disputes are resolved (Sections 19 through 23).

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live if that is older, to purchase from us or create an account. If you are under that age, you may use the Services only with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, current, and complete information, including your contact, billing, and shipping details, and to keep it up to date. You are responsible for keeping your account login details secure and for all activity under your account. Please notify us immediately at support@bondandgrain.com if you believe your account has been used without your permission. You may not transfer, sell, or share your account with anyone else.

2. Our Products

BOND&GRAIN jackets are made from genuine leather, suede, and shearling. These are natural materials, and every hide is different. Variations in grain, texture, markings, and color are natural characteristics of the material and are not defects. Leather will soften, shape to the wearer, and develop character with wear. A natural leather scent is normal and fades over time.

Product descriptions, features, and measurements are provided to help you choose. Colors and finishes may appear differently depending on your screen, device settings, and lighting, and we cannot guarantee that your screen will show colors exactly. Our size charts are a guide; fit is personal, and it is your responsibility to review the size guide and your measurements before ordering. If you are unsure, email us before ordering and we will help you choose. If your jacket arrives and does not fit, see fit verification in Section 8.

Care and wear. Leather, suede, and shearling require care. Our jackets are not waterproof. Suede and shearling are especially sensitive to rain, moisture, oils, and stains. Dark dyes may transfer onto light-colored clothing, bags, or upholstery, particularly when the jacket is new or damp. Shearling and fur trims may shed lightly during the first wears. Please follow the care guidance provided with your jacket. Wear and tear, and damage caused by weather exposure, improper cleaning or storage, alterations, or failure to follow care guidance, are not manufacturing defects.

We may change, discontinue, or limit the availability of any product at any time without notice.

3. Product Imagery and AI-Generated Content

How our imagery is created. Product images, model images, campaign visuals, and social media content published by BOND&GRAIN, including on our website, advertisements, emails, and social media accounts, are created in whole or in part using artificial intelligence (AI) image-generation tools, and may also be digitally edited or enhanced.

Models are not real people. The people, models, faces, bodies, and figures shown in our imagery are digitally generated. They do not depict, and are not intended to depict, any real person. Any resemblance to any actual person, living or deceased, is purely coincidental and unintended. The individuals shown are not our customers, employees, affiliates, or ambassadors, and do not represent an endorsement of BOND&GRAIN by any real person, unless we clearly state otherwise.

Imagery is illustrative. Our imagery is based on our actual products and is intended to show their design, color, and styling. Because the imagery is generated or digitally edited, details such as leather grain, texture, sheen, stitching, hardware, lining, proportions, drape, and how the jacket fits on the body may differ from the product you receive. The way a jacket appears on a generated model does not indicate how it will fit you. Please rely on the written product description, the listed features, and the size guide for exact specifications. If there is a difference between an image and the written product description, the written product description governs. Clothing, footwear, and accessories used for styling in our imagery are not included with your purchase unless the product description says so.

Real customer and partner content. When we share photos or videos created by real customers, affiliates, or partners, we identify or credit them as such where practical. This content is shared with the creator's permission, as described in Section 12.

If you believe an image resembles you. If you believe that any image published by BOND&GRAIN resembles you or a person you are legally authorized to represent, please email accounts@bondandgrain.com with a link to or copy of the image and a brief explanation. We will review every request promptly and in good faith and, where appropriate, remove or modify the image. Reviewing or removing an image is not an admission that the image depicts or was based on any real person.

No misuse of our imagery. You may not copy, download for reuse, alter, or use our imagery to identify, represent, or impersonate any real person; to create misleading, deceptive, defamatory, or sexually explicit content; to train AI or machine-learning models; or for any commercial purpose, without our prior written permission.

4. Custom and Made-to-Measure Orders

Custom Orders include any order placed with the "Custom" size option, custom measurements, made-to-measure specifications, personalization, or custom design details, and any order placed through our Made for You service.

Your measurements and specifications: you are responsible for providing accurate measurements and for reviewing and approving the design, fit, and specifications we confirm with you. We build your jacket to the details you approve.

Design previews: any sketch, mockup, or digital or AI-generated preview we share during the design process is a visual guide only. Your finished jacket is made from natural materials and may differ from the preview in texture, color, placement, and detail.

Approval and production: production begins only after you have approved your final measurements and specifications. Once production begins, a Custom Order cannot be canceled or changed.

Timelines: Custom Orders are typically prepared for shipment within 2–3 weeks after all measurements and details are confirmed. More complex designs may take longer, and we will give you an estimated timeline once your request has been reviewed. Delays in responding to our questions will extend the timeline. All timelines are estimates, not guarantees.

Quotes for teams and businesses: bulk, team, business, and event orders are priced and scheduled per project. If we provide you with a written quote, the quote governs the price, quantities, and timeline for that order, and these Terms govern everything else.

Final sale: Custom Orders are final sale and are handled as described in our Returns & Refunds Policy.

Designs, artwork, and logos you provide: if you submit artwork, logos, names, images, text, or other material for a custom jacket ("Customer Materials"), you confirm that you own it or have all the rights and permissions needed for us to reproduce it on your jacket, and that it does not infringe anyone's trademark, copyright, publicity, or other rights. You grant us a non-exclusive, royalty-free license to use, reproduce, and adapt your Customer Materials only to design, produce, and deliver your order. We may refuse or cancel, with a full refund, any Custom Order that we reasonably believe infringes third-party rights, is unlawful, or is offensive, hateful, or harmful. You agree to indemnify us, as described in Section 21, against claims that your Customer Materials infringe the rights of others.

5. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the products in your cart. The order confirmation email you receive confirms that we have received your order; it does not mean we have accepted it. We accept your order when we ship it to you, or, for Custom Orders, when we begin production after your approval.

We may refuse or cancel any order, or limit quantities, at our discretion, including where a product is unavailable, where we cannot verify your payment or information, where we suspect fraud or unauthorized use, where the delivery address is in a destination we do not serve, or where there is an error in the price or product information. If we cancel an order after you have been charged, we will refund the full amount paid.

Our products are sold for personal use and not for commercial resale. We may decline orders that appear to be placed by resellers or distributors, or orders for multiple quantities of the same product placed primarily to try different sizes, as described in our Shipping Policy. This does not apply to business or team orders agreed with us in writing.

Please review your order carefully, including your size, product details, and delivery address, before submitting it. Cancellations are handled as described in our Returns & Refunds Policy.

6. Prices and Payment

All prices are set in U.S. dollars. If you choose to view prices or pay in another currency, the converted price is calculated at the exchange rate applied at checkout, and your bank or card issuer may charge its own conversion fees. Prices, products, and promotions may change at any time without notice. The price charged for your order is the price shown at checkout when you place your order.

Unless stated otherwise at checkout, prices do not include applicable sales taxes, customs duties, import taxes, or brokerage fees. Any applicable sales tax is calculated and shown at checkout. International customers are responsible for duties and import taxes charged by their destination country, as described in our Shipping Policy.

We accept the payment methods shown at checkout. You confirm that you are authorized to use the payment method you provide and that your payment information is accurate. You authorize us and our payment processors to charge your payment method for the total amount of your order, including taxes and any applicable fees. Payments are processed by third-party payment providers, and we do not store your full card details.

If a product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel any order placed for that product, even after the order has been confirmed or your payment has been charged, and we will refund the full amount paid.

7. Shipping, Title, and Risk of Loss

We ship to most countries, with the exceptions listed in our Shipping Policy, which explains processing times, carriers, tracking, delivery, duties, and delivery issues. Delivery dates are estimates and are not guaranteed.

Title to and risk of loss for your order pass to you when the carrier delivers your order to the shipping address you provided. You are responsible for providing a complete and accurate shipping address. We are not responsible for orders delayed, lost, or misdelivered because of an incorrect or incomplete address. If you refuse a delivery or a parcel cannot be delivered, the Returns & Refunds Policy applies (see Section 8).

You agree to comply with all applicable export control and sanctions laws. We do not ship to, and you may not order for delivery to, any country, region, or person subject to U.S. sanctions or embargoes.

8. Returns, Refunds, and Cancellations

Returns, exchanges, refunds, and order cancellations are governed by our Returns & Refunds Policy, which forms part of these Terms and applies to every order. Please read it before you buy. The key points are summarized below. If there is any difference between this summary and the Returns & Refunds Policy, the Returns & Refunds Policy governs.

No change-of-mind returns. We do not accept returns, exchanges, or refunds because you changed your mind, no longer want the item, or would prefer a different style or color. By placing an order, and by ticking the Terms of Service box where it is shown, you confirm that you have read and accept this.
Fit verification. If a jacket from a standard order does not fit, contact us within 14 days of delivery and send photos of you wearing the jacket together with your measurements. Our team will review your request within 2 business days. If we confirm a fit issue, you may choose an exchange or a refund, as described in the Returns & Refunds Policy. Any photos and measurements you send are handled as described in our Privacy Policy.
Custom Orders and Sale Items are final sale. Sale Items are items shown with a crossed-out price or marked "Final Sale."
Damaged, defective, or incorrect items. Contact us within 48 hours of delivery with photos, and we will resolve it as described in the Returns & Refunds Policy.
Return conditions, shipping, and inspection. Return conditions, return shipping costs, and inspection and refund timing are set out in the Returns & Refunds Policy.
Refused or undeliverable parcels. Refusing a delivery is not a return and does not by itself entitle you to a refund. See the Returns & Refunds Policy.

Disputes and chargebacks. If you have a problem with an order, please contact us at support@bondandgrain.com before opening a dispute with your bank or card issuer, so that we have the chance to resolve it. If you file a chargeback for a transaction that was authorized and fulfilled in accordance with these Terms, we may provide your payment provider with your order and payment records, the Terms and policies that applied to your order, shipping and delivery confirmation, and our correspondence with you, and we may decline future orders from you. Card-network and payment-provider dispute rules may also apply.

9. Promotions and Discount Codes

From time to time we may offer promotions, discount codes, or gifts with purchase. Each promotion is subject to the terms stated with it. Unless those terms say otherwise, discount codes are limited to one per order, cannot be combined with other offers, have no cash value, cannot be applied to previous orders, and may be withdrawn or changed at any time. We may cancel orders or discounts obtained through misuse of a promotion, including through multiple accounts or codes shared outside their intended use. If there is a conflict between a promotion's terms and these Terms, the promotion's terms govern for that promotion.

10. Affiliate Program

Participation in the BOND&GRAIN affiliate and partnership program is subject to approval and to the program terms published on our Affiliate Program page, which form part of these Terms for program participants. Affiliates must clearly disclose their relationship with BOND&GRAIN in accordance with the laws and advertising standards that apply in their market, including the U.S. Federal Trade Commission's endorsement guidelines. Affiliates may not bid on BOND&GRAIN brand terms in search advertising or use the BOND&GRAIN name in any domain name, account name, or handle.

Affiliates who share BOND&GRAIN imagery must use it as supplied, must follow each platform's rules for labeling AI-generated content, and must not present any AI-generated model or image as themselves, as a real customer, or as a real photograph of a person. We may suspend or end an affiliate's participation, and withhold commissions on sales obtained in breach of the program terms, if an affiliate breaches these Terms or the program terms.

11. Email and Text-Message Communications

If you subscribe to our newsletter or text messages, you agree to receive marketing communications from us. You can unsubscribe from emails at any time by clicking the unsubscribe link in any email.

By opting in to text messages, you agree to receive recurring automated marketing and order-related text messages from BOND&GRAIN at the mobile number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help, or contact us at support@bondandgrain.com. Carriers are not liable for delayed or undelivered messages. You confirm that you are the account holder or an authorized user of the mobile number you provide. We use and protect your information as described in our Privacy Policy.

Even if you unsubscribe from marketing, we will continue to send you messages about your orders, returns, and account.

12. Reviews, Content, and Feedback

If you submit reviews, photos, videos, comments, or other content to us, post content that tags or mentions BOND&GRAIN on social media, or send us ideas or feedback ("User Content"), you grant BOND&GRAIN a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, edit for length and format, and share that User Content, with credit where practical, on our website, social media, and marketing channels. Where we wish to use your User Content in paid advertising, we will ask your permission first.

Fit verification photos and measurements you send us for a return or exchange request are not User Content for marketing purposes. We use them only to review and resolve your request, as described in our Privacy Policy.

You confirm that your User Content is your own, is accurate, does not infringe anyone's rights, and does not contain anything unlawful, defamatory, obscene, hateful, or misleading. Reviews must reflect your genuine experience with a product you have purchased or received. We may remove or decline to publish any User Content at our discretion. We have no obligation to use, pay for, or keep confidential any ideas or feedback you send us.

13. Intellectual Property

The Services and their content, including the BOND&GRAIN name and logo, the golden spiral mark, "The Living Code," product names, product designs, imagery, videos, text, graphics, and the look and feel of the website, are owned by or licensed to BOND & GRAIN LLC and, to the extent protected by law, are protected by trademark, copyright, trade dress, and other intellectual property laws. Whether or not any particular content, including AI-generated imagery, qualifies for intellectual property protection, your right to use the Services is conditioned on your compliance with the restrictions in this section and in Section 3.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial shopping. You may not copy, reproduce, scrape, modify, distribute, sell, or create derivative works from any part of the Services, or use our names, logos, trademarks, or imagery, without our prior written permission, except that approved affiliates may use the assets we supply in accordance with the affiliate program terms.

If you believe that content on the Services infringes your copyright or other rights, please email accounts@bondandgrain.com with a description of the work, the location of the material on the Services, your contact details, and a statement that you have a good-faith belief that the use is not authorized. We will review and respond to every notice we receive.

14. Prohibited Uses

You agree not to use the Services to:

break any law or regulation, or encourage anyone else to do so;
infringe our intellectual property or anyone else's rights;
place fraudulent orders, use stolen or unauthorized payment methods, or abuse our returns, promotions, or affiliate program;
harass, threaten, abuse, or discriminate against anyone, including our team;
submit false, misleading, or impersonating information, including false or misleading photos or measurements in a fit verification request;
upload or send viruses, malware, or any other harmful code;
scrape, crawl, or collect data, content, or imagery from the Services using automated means, including to train AI or machine-learning models, without our written permission;
interfere with, disrupt, or attempt to gain unauthorized access to the Services, our systems, or other users' accounts; or
copy or resell our products, designs, imagery, or content for commercial purposes without our written permission.

We may suspend or terminate your access to the Services, and cancel any related orders, if you breach this section.

15. Third-Party Services and Links

The Services are hosted by Shopify, and we use third-party providers for payments, shipping, order tracking, and communications. Your use of those services may also be subject to the providers' own terms and privacy policies. The Services may also link to third-party websites and platforms, such as social media sites. We do not control and are not responsible for third-party websites, services, content, or practices, and a link does not mean we endorse them. You use third-party services at your own risk.

16. Privacy

Your submission of personal information through the Services, including any photos and measurements you send us for fit verification, is governed by our Privacy Policy, which explains how we collect, use, retain, and share your information and the choices and rights available to you.

17. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, imagery, pricing, promotions, availability, shipping times, or other details. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order. If we cancel an order for this reason, we will refund the full amount paid.

18. Availability of the Services

We work to keep the Services available and secure, but we do not guarantee that they will be uninterrupted, timely, error-free, or free of viruses or other harmful components. We may suspend, change, or discontinue any part of the Services at any time, including for maintenance or updates.

19. Disclaimer of Warranties

Except as expressly stated in these Terms and our policies, and to the fullest extent permitted by law, the Services and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will meet your requirements or that any content on them is complete or accurate.

Some states and countries do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any warranty or right that cannot be excluded or limited under the law that applies to you, including your statutory rights for faulty or misdescribed goods.

20. Limitation of Liability

To the fullest extent permitted by law, BOND&GRAIN and its members, managers, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Services or any product, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Services, or any product will not exceed the amount you paid to BOND&GRAIN for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BOND&GRAIN and its members, managers, employees, contractors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms, your violation of any law or the rights of any third party, your misuse of our imagery, your User Content, or any Customer Materials you provide for a Custom Order.

22. Dispute Resolution

Informal resolution first. Most concerns can be resolved quickly. Before filing any claim, you agree to email us at accounts@bondandgrain.com with your name, order number if applicable, and a description of the issue and the resolution you are seeking. We will try in good faith to resolve the issue with you within 30 days of receiving your notice. If we cannot resolve it within that time, either of us may pursue the claim as described below.

Where claims are brought. Any claim arising out of or relating to these Terms, the Services, or any product will be brought exclusively in the state or federal courts located in Natrona County, Wyoming, and you and BOND&GRAIN consent to the personal jurisdiction of those courts. However, either of us may bring an individual claim in a small claims court in the county where you live, if the claim qualifies.

Individual claims. To the fullest extent permitted by law, you and BOND&GRAIN agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Time limit. To the extent permitted by law, any claim must be brought within one year after the claim arises; otherwise, it is permanently barred.

If you live in the United Kingdom or the European Union, nothing in this section prevents you from bringing a claim in the courts of the country where you live or deprives you of the protection of the mandatory consumer laws of that country.

23. Governing Law

These Terms and any dispute arising out of or relating to them, the Services, or any product are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, except where the consumer protection laws of the state or country where you live require otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

24. Events Beyond Our Control

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, severe weather, pandemics, war, terrorism, civil unrest, government actions, customs holds, strikes, labor shortages, shortages of materials, carrier delays, power or internet outages, or failures of third-party service providers. If such an event affects your order, we will contact you and, where appropriate, offer a revised timeline or a refund.

25. Termination

These Terms apply until terminated by you or us. You may stop using the Services at any time and may ask us to close your account by emailing support@bondandgrain.com. We may suspend or terminate your access to the Services at any time, without notice, if you breach these Terms or if we reasonably suspect fraud or misuse. Sections that by their nature should survive termination will survive, including those on orders already placed, returns and refunds, product imagery, intellectual property, User Content, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

26. General Terms

Entire agreement: these Terms, together with the policies referenced in them and any written quote or promotion terms that apply to your order, are the entire agreement between you and BOND&GRAIN regarding the Services and replace any prior agreements or communications.

Order of precedence: if there is a conflict between these Terms and a policy referenced in them, the more specific policy governs the subject it covers (for example, the Returns & Refunds Policy for returns, exchanges, refunds, and cancellations, and the Shipping Policy for shipping).

Severability: if any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

No waiver: our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment: you may not assign or transfer these Terms or your rights under them without our written consent. We may assign or transfer these Terms, including in connection with a merger, acquisition, or sale of our business.

Headings: headings are for convenience only and do not affect the meaning of these Terms.

Language: these Terms are written in English. If they are translated, the English version governs to the extent permitted by law.

Electronic communications: you agree that we may communicate with you electronically, including by email and through notices on the Services, and that electronic communications satisfy any legal requirement that a communication be in writing.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, Services, practices, or legal requirements. We will post the updated Terms on this page and update the "Last updated" date above. If the changes are material, we will provide additional notice where required by law. Changes apply to orders placed and use of the Services after the updated Terms are posted. The Terms in effect when you placed an order apply to that order.
